All services are professional guidance and consulting services. Results may vary based on client participation, implementation, timing, and organizational factors.
Scheduling and Payments
Payment may be required in full or in part before services are rendered. All pricing is listed in U.S. dollars unless otherwise stated.
Bookings are subject to availability.
Cancellation & Rescheduling Policy
Individual Sessions
(Executive Clarity Sessions, Strategic Consultations, Advisory Calls)
48+ Hours Notice: May be rescheduled at no additional charge within 30 days.
24–48 Hours Notice: Subject to a 50% rescheduling fee or credit adjustment.
Less Than 24 Hours Notice: Charged in full. No refund.
No-Show: Charged in full with no refund or reschedule.
Cancellation by Fay Ferguson
If Fay Ferguson must cancel a session, clients will be offered either:

Rescheduling at no charge, or
-
Full refund for that session
Monthly Advisory Retainers
Retainer services begin on the agreed start date and follow the terms outlined in the client agreement.
Monthly Retainers: Require 30 days written notice to cancel unless otherwise stated in contract.
Unused advisory time does not roll over unless specifically agreed in writing.
Project Engagements
Project-based consulting services require a signed agreement outlining scope, deliverables, payment schedule, and timelines.
Deposits for project engagements may be non-refundable once work has begun.
Any changes to scope may require revised pricing and timelines.
Workshops & Speaking Engagements
Workshop and speaking fees vary based on format, audience size, travel requirements, preparation needs, and customization.
Separate agreements may apply for events, training sessions, or keynote engagements.
Refund Policy
Due to the nature of consulting and advisory services, refunds are generally not provided for completed sessions or delivered work.
Refund requests for unused prepaid services may be reviewed on a case-by-case basis.
Approved refunds will be processed within 14 business days to the original payment method when possible.
Client Responsibility
Clients are responsible for:

Providing accurate information

Attending scheduled sessions on time

Participating in good faith

Implementing recommendations at their discretion
Fay Ferguson is not responsible for outcomes resulting from lack of implementation or incomplete information.
Confidentiality
Information shared during private sessions will be handled professionally and respectfully. However, confidentiality is not guaranteed in cases involving legal obligations, threats of harm, or where disclosure is otherwise required by law.
Intellectual Property
All website content, frameworks, materials, written resources, and branded concepts are the property of Fay Ferguson and/or The Malinda Group, LLC unless otherwise stated.
No content may be copied, reproduced, or distributed without written permission.
Limitation of Liability
Fay Ferguson and The Malinda Group, LLC shall not be liable for indirect, incidental, or consequential damages arising from the use of this website or services.
Maximum liability shall not exceed the amount paid by the client for the specific service in dispute.
Force Majeure
We are not liable for delays or inability to perform due to events beyond reasonable control, including natural disasters, illness, technology outages, emergencies, or government actions.
Changes to Terms
We reserve the right to update these Terms and Conditions at any time. Updated terms become effective once posted on this website.
